It is very important for those managing a Body Corporate to have a safety
inspection undertaken. The purpose being that if the Body Corporate engage
contractors to carry out works for the Body Corporate, and an incident
occurs, you as a Body Corporate Manager could be sued and also fined individually
over that incident.
Under the Workplace Health and Safety Act, the Body Corporate is classed
as a ' person in control ' of a workplace.
Section 30(1) of the WHS Act states that a person in control of a workplace
have the following obligations to ensure:
- the risk of injury/illness from a workplace is minimised for persons
coming onto the workplace to work
- the risk of injury/illness from any plant or substance provided
by the person for the performance of work by someone other than the
persons' workers is minimised when used properly
- that there is appropriate, safe access to and from the workplace
for persons other than the persons' workers
